The Rights Granted to an Employer When a Worker Is Injured
In Missouri, as in other states, a person who allegedly suffers an injury in the workplace has a right to file a workers’ compensation claim, seeking benefits for potential lost income and for the cost of any “reasonable and necessary” medical care. Unlike most other states, though, Missouri gives the employer in a workers’ comp matter the right to choose the medical professional who will examine and treat the employee. A worker may elect to be treated by their own doctor, but if they do, they must pay all the costs of doing so, unless the employer or the workers’ compensation insurance provider has approved the services.
Must An Employer in Missouri Allow a Worker Paid Time Off for Medical Treatment?
No. An employer has the discretion to allow a worker to participate in medical evaluation and treatment, including physical therapy or rehabilitation, without using vacation, sick leave, or other benefits. However, the employer can also elect to require the employee to use those benefits to attend treatment sessions.
Must An Employer Pay Employee Costs to Travel for Care Outside the Local Area?
As a general rule, yes, if the employee must go somewhere outside of the general metropolitan area where the employer has its principal place of business (and where the employee works), the employer must cover the employee’s travel expenses. However, an employer will not be required to reimburse an employee for travel in excess of 250 miles each way to and from treatment.
Are There Any Restrictions on When an Employer May Request a Medical Examination?
Missouri law allows an employer to periodically or regularly request that an employee submit to a medical examination, provided the requests are deemed “reasonable.” If the request is considered reasonable and the employee refuses to comply, benefits may be terminated.
